Terms of Service

Welcome to eCommarkt. These Terms of Service govern your use of our platform — including our website, mobile application, and all related services. Please read them carefully before using eCommarkt.

1. Acceptance of Terms

By accessing or using eCommarkt — including our website, mobile app, or any related service — you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

These terms apply to all users: customers, shop owners, service providers, and visitors. We may update these terms from time to time. Continued use of our platform after any change means you accept the updated terms.

2. User Eligibility

To use eCommarkt, you must:

  • Be at least 18 years of age, or have parental or guardian consent
  • Have a valid mobile number and email address
  • Provide accurate and complete registration information
  • Keep your account credentials secure and not share them with others
  • Not have been previously banned or suspended from our platform

Shop owners must additionally comply with all applicable local business laws and regulations.

3. What eCommarkt Does

eCommarkt is a local commerce platform that connects customers with nearby shop owners. We provide the technology — the website and mobile apps — but we do not sell products ourselves.

Product Marketplace

Customers can browse and order products from local shops. All products listed on eCommarkt come from our verified marketplace — shop owners add products from our catalogue.

Service Booking

Customers can book appointments and services — such as salon, home repairs, and cleaning — from registered service providers.

No Delivery by eCommarkt

eCommarkt does not provide delivery services. Delivery or pickup arrangements are made directly between the customer and the shop owner. Check the shop's available fulfillment options before placing your order.

4. Orders & Payments

Placing an Order

When you place an order, you are making an offer to purchase from a shop owner. The order is confirmed only after the shop owner accepts it. eCommarkt facilitates the transaction but is not a party to the sale.

Pricing

All prices are in Indian Rupees (INR). Prices are set by shop owners and may vary. Once an order is confirmed, the price will not change.

Payment

eCommarkt supports UPI payments. You will be required to enter your UPI Transaction ID as proof of payment after completing the payment on your UPI app. Always verify the UPI ID of the shop before making payment.

5. Cancellation & Returns

Important — Read Before Ordering

Cancellation and return policies on eCommarkt are set individually by each shop owner for each product. eCommarkt does not have a universal cancellation or return policy.

How to Check Cancellation Policy

Before placing an order, open the product details page. If the shop owner has enabled cancellation, it will be clearly mentioned on the product page — including until what order status cancellation is allowed and whether a refund applies.

If Cancellation is Not Enabled

If a product does not show a cancellation option, the order cannot be cancelled once placed. We strongly recommend reviewing the product and shop details carefully before confirming your order.

Refunds

Refunds, if applicable, are processed as per the cancellation policy set by the shop owner. eCommarkt will assist in facilitating refund disputes between customers and shop owners, but final resolution depends on the shop's policy.

Service Bookings

For service bookings, cancellation terms are set by the service provider. Check the service details page for the applicable cancellation window before booking.

6. Shop Owner Responsibilities

By registering as a shop owner on eCommarkt, you agree to the following:

  • Provide accurate product descriptions, images, prices, and stock information at all times.
  • Process accepted orders promptly and keep customers informed about order status.
  • Honour the cancellation and refund policy you have set for each product.
  • Ensure products meet applicable safety and quality standards and are exactly as described.
  • Only list products from the eCommarkt marketplace catalogue. Custom product additions require admin approval.
  • Not misuse the platform, manipulate ratings, or engage in fraudulent activity.
  • Handle customer complaints and queries in good faith.

Violation of these responsibilities may result in shop suspension or permanent removal from the platform.

7. Prohibited Activities

The following activities are strictly prohibited on eCommarkt:

  • Selling counterfeit, prohibited, or illegal products or services
  • Providing false or misleading product information or images
  • Manipulating reviews, ratings, or order counts
  • Harassing, threatening, or abusing other users
  • Attempting to bypass platform payment processes
  • Using automated bots or scrapers to access the platform
  • Sharing account credentials or creating multiple accounts for abuse
  • Fraudulent transactions or chargeback abuse
  • Collecting personal data of other users without consent
  • Interfering with platform security or operations

Violations may result in immediate account suspension, legal action, and reporting to the relevant authorities.

8. Limitation of Liability

eCommarkt is a technology platform that connects buyers and sellers. We do not manufacture, store, or directly sell any products. We are not liable for the quality, safety, or accuracy of products and services listed by third-party shop owners.

To the maximum extent permitted by applicable law, eCommarkt shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, business, or data, arising from your use of — or inability to use — the platform.

Our total liability for any specific claim shall not exceed the amount you paid for the transaction in question.

9. Intellectual Property

All content on eCommarkt — including the logo, design, interface, and software — is owned by eCommarkt or its licensors and is protected by applicable intellectual property laws.

By submitting content to the platform (such as product images or reviews), you grant eCommarkt a non-exclusive, royalty-free licence to use and display that content on the platform.

Shop owners retain ownership of their product content but grant eCommarkt the right to display it for the purpose of facilitating sales.

10. Dispute Resolution

If you have any issue with an order, service, or another user, please contact our support team first. We will make every effort to resolve the matter promptly.

If a dispute cannot be resolved through support, it may be escalated to mediation or arbitration in accordance with the Indian Arbitration and Conciliation Act.

These terms are governed by the laws of India. Any legal proceedings shall be conducted in the courts of Ahmedabad, Gujarat.

11. Account Termination

You may deactivate your account at any time through your account settings. Any pending orders or bookings must be completed or cancelled before deactivation.

eCommarkt may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Abuse customers, shop owners, or platform staff
  • Have extended inactivity (shop owners)

Upon termination, access to the platform will be revoked, pending transactions will be processed, and applicable refunds or payouts will be settled.
